The terms "we", "us" and "our" refer to Carrie's Crafted Celebrations, operated by Carrie Slovak as an individual and sole proprietor located and registered in Shiawassee County, State of Michigan. Carrie's Crafted Celebrations operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Carrie's Crafted Celebrations is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services. Please read these Terms of Service carefully. By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. SECTION 1 - ACCESS, ACCOUNT, AND RENTAL ELIGIBILITY

• Age Requirements: By agreeing to these Terms of Service, you represent that you are at least 18 years of age. Minor dependents may participate in hosted experiences or game kits solely under the direct supervision, consent, and financial responsibility of a parent or legal guardian.

• Information Accuracy: To use the Services, including browsing our online store or purchasing experiences, you may be asked to provide certain information, such as your email address, phone number, billing, and shipping details. You represent and warrant that all information you provide is correct, current, and complete.

• Account Security: You are solely responsible for maintaining the security of your account interactions and for all account activity. You may not transfer or assign your account access to any other person.

SECTION 2 - OUR PRODUCTS, GAME KITS, AND SERVICES

• Service Portfolio: We provide custom event planning for holidays and special occasions, professional holiday decorating services, and the development of immersive, in-home interactive games.

• Rental Nature of Game Kits: When purchasing the game known as “Race for the Bloom” (the “Game”), you acknowledge and agree that you are purchasing a limited-use game rental experience rather than ownership of physical game components. All physical materials, documents, props, clues, and puzzles remain the exclusive property of Carrie’s Crafted Celebrations and must be returned following your gameplay.

• Waiver and Signature Requirements: All intended participants must sign or electronically acknowledge our formal Game Participation, Rental, Return, and Proprietary Materials Agreement before a physical game kit is mailed out. We reserve the right to delay or cancel shipment if all required acknowledgments and minor waiver signatures are not received.

SECTION 3 - ORDERS AND MANUAL PROCESSING WINDOW

• Offer to Purchase: When you place an order, you are making an offer to purchase or rent an experience. Carrie's Crafted Celebrations reserves the right to accept or decline your order for any reason at its discretion.

• Manual Processing Window: To ensure every custom order, registration setup, and digital link is prepared with exact precision, please allow 24 to 48 hours for us to manually process your order, verify required waivers, and arrange shipment.

• Cancellations and Returns: Your purchases are subject to cancellations or refunds solely in accordance with our specialized Refund Policy. Because the value of our game kits depends entirely upon the secrecy of their puzzles and clues, refunds are strictly unavailable once any game materials have been opened, accessed, or used.

• Commercial Restrictions: You represent and warrant that your purchases are for your own personal, non-commercial entertainment use and not for commercial resale, reproduction, or export. Groups larger than eight (8) players are required to order an additional game kit to ensure a hands-on experience for all participants.

SECTION 4 - PRICES AND BILLING

• Price Changes: Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Posted prices do not include shipping, handling, or applicable sales taxes.

• Payment Terms: You agree to provide current, complete, and accurate purchase and payment information. You represent and warrant that you are duly authorized to use your chosen payment method, that charges will be honored by your credit card company, and that you will pay all posted charges, including applicable shipping, handling, and fees.

• Security Deposit: A refundable Security Deposit of $50 may be collected at checkout to secure the safe, timely return of non-consumable, protected game materials. Inspection and administration of this deposit are governed by the specific terms in your signed Game Participation Agreement.

SECTION 5 - SHIPPING, DELIVERY, AND RETURNS

• Carrier Responsibilities: We are not liable for shipping and delivery delays caused by postal carriers, weather, or events outside our reasonable control. Responsibility for returned game rental materials remains with you until the return package is physically accepted and scanned by our designated shipping carrier.

• Geographic Constraints: Our physical game shipping services are strictly restricted to the United States. International shipping zones are deactivated, and checkout will be blocked for addresses outside domestic delivery markets.

SECTION 6 - INTELLECTUAL PROPERTY AND PROPRIETARY CONTENT

• Ownership: All Game components, including but not limited to storylines, characters, written materials, puzzles, puzzle sequencing, clues, treatment systems, game mechanics, custom graphics, artwork, layouts, formatting, and overall narrative structures are the exclusive intellectual property of Carrie Slovak and Carrie’s Crafted Celebrations. They are strictly protected under U.S. copyright, trademark, and other intellectual property laws.

• Personal License Only: These Terms permit you a limited, non-exclusive, non-transferable license to use our game kits solely for personal, non-commercial recreational purposes. You must not reproduce, scan, upload, distribute, livestream, publicly display, resell, rewrite, or create derivative works from any portion of our materials without our prior written consent.

• Fictionalized Content Disclaimer: Our games include creative, fictionalized, and entertainment-based adaptations. Any treatment plans, environmental conclusions, or problem-solving methods presented during gameplay are fictionalized puzzle mechanics and do not constitute professional botanical, ecological, medical, or scientific advice.

SECTION 7 - SPOILER POLICY AND MEDIA RESTRICTIONS

• Protection of Gameplay Secrecy: The integrity of our experiences depends entirely upon secrecy and undisclosed solutions for future players.

• Prohibited Disclosures: You agree not to publicly disclose or distribute puzzle answers, hidden codes, solution paths, key mechanics, or decipherable images of solution materials through social media, websites, forums, or online video platforms.

• Photography Permitted: Players are highly encouraged to take casual commemorative photos of their experience, provided that puzzle text is not legible, hidden clues are obscured, and the imagery cannot reasonably be used by others to replicate or solve the game.

SECTION 8 - FAIR PLAY AND EQUIPMENT RULES

• No Internet Research: To preserve leaderboard and competition integrity, players agree not to use outside internet research, external answer guides, or publicly shared walkthroughs while actively participating in the Game.

• Prohibited Device Use: Internet-connected smart devices are strictly prohibited during gameplay. The only exceptions are if a phone is explicitly required as a stopwatch, a magnifying tool, or to communicate directly among teammates who are physically separated. All hint systems, verification elements, and solution controls are entirely physical, tactile, and contained right inside the box.

SECTION 9 - OPTIONAL TOOLS AND THIRD-PARTY LINKS

• Third-Party Features: You may be provided with access to tools or hyperlinks operated by third parties (such as workflow automation platforms or document signing solutions). We provide access to such integrations "as is" without representations or endorsements of any kind.

• External Risk: Any use of optional tools or third-party links is entirely at your own risk. We are not liable for any harm or damages related to your transactions or interactions on external websites.

SECTION 10 - RELATIONSHIP WITH SHOPIFY

• Platform Hosting: Carrie's Crafted Celebrations is powered by Shopify, which provides the ecommerce platform enabling us to offer the Services to you. However, any sales, custom rentals, or agreements you make in our Store are made directly with Carrie's Crafted Celebrations.

• Release of liability: You acknowledge and agree that Shopify is not responsible for any aspect of sales between you and us, including any injury, damage, or loss resulting from products or services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your transactions with Carrie's Crafted Celebrations.

SECTION 11 - PRIVACY AND DATA PROCESSING

• Data Flow: All personal information collected through our Services is subject to our Privacy Policy. Because our Services are hosted by Shopify, Shopify collects and processes personal information about your checkout access to fulfill orders, process payments, and improve platform security. • Accuracy: You agree that your feedback will not contain unlawful, abusive, or defamatory content, nor contain malware or viruses. You may not use a false email address or mislead us as to the origin of any submissions.

SECTION 13 - PROHIBITED USES

• Lawful Access Only: You are prohibited from using the site, its content, or our game services: (a) for any unlawful purpose; (b) to infringe upon or violate our intellectual property or the rights of others; (c) to submit false, misleading, or fraudulent information; (d) to upload or transmit viruses or malicious code; (e) to collect or track the personal data of others; or (f) to scrape, extract, or automatically gather data from our services using automated extraction tools or AI frameworks. We reserve the right to terminate your service access or void order fulfillment immediately for violating these boundaries.

SECTION 14 - TERMINATION

• Account Review: We may terminate this agreement or suspend your access to our retail services at our sole discretion at any time without notice, and you will remain liable for all outstanding return obligations, fees, or replacement costs due up to the date of termination.

SECTION 15 - DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

• General Disclaimer: EXCEPT AS EXPRESSLY STATED BY CARRIE'S CRAFTED CELEBRATIONS, THE SERVICES AND ALL PRODUCTS AND EXPERIENCES MAILED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED.

• Liability Cap: TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXCEPT IN CASES OF GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR VERIFIABLE PERSONAL INJURY, THE TOTAL LIABILITY OF CARRIE'S CRAFTED CELEBRATIONS, OUR EMPLOYEES, CONTRACTORS, OR AGENTS ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR GAME KITS SHALL NOT EXCEED THE TOTAL AMOUNT PAID FOR YOUR SPECIFIC PURCHASE OR RENTAL TRANSACTION, EXCLUDING ANY RETURNED SECURITY DEPOSIT.

SECTION 16 - INDEMNIFICATION

• Customer Cooperation: You agree to indemnify, defend, and hold harmless Carrie's Crafted Celebrations, Shopify, and our affiliates from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, arising out of your breach of these Terms of Service, your violation of any law, or your misuse of the rental services.

SECTION 17 - SEVERABILITY AND ENTIRE AGREEMENT

• Enforceability: If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed without affecting the validity of any remaining provisions.

• Full Integration: These Terms, alongside our active Privacy Policy and signed Game Participation Agreements, constitute the entire agreement between you and Carrie's Crafted Celebrations, superseding any prior verbal or written communications.

SECTION 18 - GOVERNING LAW AND VENUE

• Michigan Jurisdictional Framework: These Terms of Service, your operational rental transactions, and any legal matters relating to Carrie's Crafted Celebrations shall be governed by, construed, and enforced in accordance with the laws of the State of Michigan, without regard to conflict of law principles.

• Designated Legal Venue: Any legal dispute, property damage claim regarding rental assets, or contractual issue arising from these services shall be resolved exclusively in either the state courts sitting in Shiawassee County, State of Michigan, or the United States District Court for the Eastern District of Michigan. Each party irrevocably submits to the personal jurisdiction and venue of such courts.
